Federal Court Orders Release of Abrego Garcia from ICE Custody

A court has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, finding his ongoing detainment is without legal authority.

"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis stated in her order.

The situation originates in a erroneous removal to El Salvador in March, which US authorities later acknowledged was an error. Following his repatriation to the United States to face alien smuggling charges, he was held in federal custody.

In her order, the judge noted that the government lacks a current deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."

Background of the Case

The court proceedings center on conflicting assertions. While the Trump administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically denies this allegation.

He has also entered a not guilty plea to the smuggling counts, which are part of a ongoing trial in the state of Tennessee.

Terms of Release

The court, who was hearing his challenge to deportation in a Maryland district court, ruled that he must now comply with the terms of his bond from jail in Tennessee. This order shifts his supervision to the Tennessee court.
